Please Note the following Changes to the PEINU Collective Agreement

Please be advised that PEINU and the Employer have agreed to reinstate the following provisions to the Collective Agreement:

When a Permanent Employee resigns from his/her position with the Employer and within ninety (90) days is re-employed in a permanent position with the Employer, there is an agreement that the Employee will be entitled to reinstatement of the following benefits:

(a) salary step earned and increment date;

(b) accumulated sick days;

(c) accumulated retiring allowance days; and

(d) length of vacation entitlement.

The right to such benefits shall be negated by an unsatisfactory employment record.

When an Employee is re-employed as outlined above, notwithstanding Article 20.4 (a), reinstatement of seniority shall be considered on an individual basis by the Union.

This language was contained in the former Collective Agreement in Article 42 – Portability of Benefits and was removed during the last round of collective bargaining. The issue of carrying ones benefits from employer to employer no longer applies, as the Health Regions have been amalgamated into the Department of Health. It has been determined that a portion of the former Article is still relevant under the new, single employer. This is the portion that the parties have agreed to reinstate. It addresses an employee’s ability to maintain the stated benefits if he/she terminates her/his employment with the Department of Health and, within 90 days, is reemployed by the same Department.

These provisions are retroactive to the commencement of the current Collective Agreement (September 24th, 2006) and will operate until the next round of collective bargaining, when they will be reviewed again. Inserts for your Collective Agreements containing the new language will be available in the near future from your Local Presidents and/or Worksite Representatives.
